As a result of a dike rupture, millions of gallons of fly ash sludge spilled into river and surrounding community. Design firm assisted with the clean-up of the fly ash sludge. When project was completed, several workers filed claims for injuries and illnesses.

Claim arising from engineering/procurement/construction(EPC) services provided for claimant’s petrochemical facility. Following successful completion of project, design firm sought to recover approximately US$100 million for unpaid fees and costs. Claimant refused to pay, and design firm initiated arbitration proceeding seekng US$141 million. Claimant’s counterclaim, which previously sought US$654 million from design firm, was significantly reduced at outset of hearing.

Claim arising out of engineering/procurement/construction(EPC) of natural gas combined cycle power plant in Blaydin Point, Darwin, Northern Territory, Australia. Japanese authorities sought alternate power generation sources following Fukushima Daiichi nuclear disaster in 2011, and project at issue was pursued following that catastrophic event.

Owner claimed damages exceeding US$2 billion allegedly caused by EPC’s misrepresentations before and during the project, allegedly resulting in excessive costs and project execution failures.

Refinery's caustic delivery system reportedly allowed untreated caustic to corrode and crack more than seven miles of stainless-steel pipe and vessels. Incident allegedly caused $8 billion in damages.Arbitration panel found in favor of the design firm, awarding the owner $0.

Claim arising from engineering, procurement, construction, and construction-management services provided for a liquefied natural gas facilities and pipeline in Queensland, Australia.  Alleged damages exceed AUD $1.4 billion (approximately USD $1.2 billion). On behalf of insured’s insurance tower with limits in the hundreds of millions of dollars, we facilitated the exchange of information and provided independent analysis and reserve recommendations to insurers.

Claim arising from catastrophic failure of mine-tailings storage facility in British Columbia, Canada. Engineerof record faced multiple lawsuits with alleged damages of approximately CAD $400 million (approx. USD $319 million). Working closely with defense counsel, technical experts, and insurers to develop a comprehensive defense strategy while limiting defense fees and costs, we negotiated a global resolution.

Explosion at manufacturing plant resulting in multiple deaths and injuries.  Design firm paid damages exceeding $100 million.  Assisted design firm and its insurers in developing strategy to recover entire sum from plant owner under contractual indemnity theory.  Design firm (and its insurers) prevailed after lengthy trial, and recovery upheld on appeal.

Large, luxury condominium tower experienced substantial settling, leading to multiple claims by homeowners and requiring massive redesign and remediation efforts.  Advised insurers on navigating complex coverage issues regarding policy year triggered and interplay between general liability and professional liability insurance.

Claim involving various allegations arising out of design firm’s preparation of traffic forecasts provided to a consortium of contractors for use in its preparation of a bid to construct a large tunnel project in Brisbane, Queensland, Australia. Damages totaled more than AU$2 billion (approx. US$1.4 billion).  We spearheaded settlement efforts and resolved claim for significantly less than claimed amounts.
